Empoli forward Luca Saudati scored in the 55th minute with a header in between Maldini and Alessandro Nesta. The 39-year-old Maldini was playing his first game of the season following knee surgery. He had not played since Milan beat Liverpool in the Champions League final on 23 May.
Milan's only win at home this season came against Benfica in the Champions League last month to open their European Cup defence.
Fiorentina won 3-0 over Siena in a Tuscan derby. Giampaolo Pazzini, Adrian Mutu and Christian Vieri scored for the Viola.
