The 29-year-old was injured in a high-speed crash in Dallas on October 10, where his car “flipped multiple times”.
The American was immediately taken to an intensive care unit after he was thrown from the car as it veered off the road.
Spence, the world welterweight champion, was not wearing a seatbelt.
He has been charged with a class B misdemeanour, which is punishable by a fine of up to £1,500 and up to 180 days in jail, say Dallas Police.
On Thursday, Spence posted on social media for the first time since his crash, writing: “No broken bones, I’m a savage!!”
The crash came just 12 days on from his win over Shawn Porter, which secured him the WBC world welterweight crown to go with the IBF title he has held since 2017.
