Couple caught having sex in Domino's pizza spared prison but told they must sleep apart

A couple who were caught having sex in a Domino’s Pizza shop have been spared jail.
Daniella Hirst, 29, and Craig Smith, 31, both from Bridlington, east Yorkshire, pled guilty on charges of outraging public decency at Scarborough Magistrates court last month.
Judges told the pair that the offence was serious enough to send them to jail, earlier this week. But instead they sentenced to 12 month long community orders.
The couple must also observe a curfew order between 7pm and 7am for 23 weeks and wear an electronic tag.
Hirst is required to perform a rehabilitation activity for 10 days, while Smith must submit to the same orders for 15 days. Her boyfriend must also complete 200 hours of unpaid work.
Graphic video footage of the offence was shown during their trial in February.
The pair were caught having sex in a Domino’s pizza delivery shop in Scarborough, while staff worked on the other side of the counter.
The 18-minute long security video shows the couple ordering food in the shop. Hirst later performs oral sex on Smith, before the couple have sex while leaning on the counter, close to the till.
Delivery staff are seen walking past the couple and employees are seen working on the other side of the counter. It is unclear if they could see what was going on.
Chairman of the bench Charles David told the pair: “You were both very close to going to prison. It was a brazen offence, committed in a public place over a prolonged period and in the presence of staff.”
Mr Davis said that while there was no “identifiable victim” in the case and the couple were clearly under the influence of alcohol, the potential for harm was “significant”.
He added that it seemed to him and his fellow magistrates, that "the harm caused was to the public who were outraged after the CCTV was released on social media.”
