The US Food and Drug Administration (FDA) currently prohibits adding CBD (cannabidiol) – a non-psychoactive chemical compound found in the marijuana plant – to food and drinks.
However, on Friday 31 May the FDA is holding a public hearing during which the "scientific data and information about the safety" of CBD-infused products will be discussed.
Ben and Jerry's has submitted a comment to the FDA in support of the legalisation of CBD-infused foods and beverages.
Matthew McCarthy, CEO of Ben and Jerry's, explained that the company has devised a CBD-infused ice cream in light of high demand from fans.
"We've listened and brought them everything from non-dairy indulgences to on-the-go portions with our pint slices," McCarthy said.
"We aspire to love our fans more than they love us and we want to give them what they're looking for in a fun, Ben and Jerry's way."
Ben and Jerry's is encouraging customers to submit comments to the FDA in support of the legalisation of CBD-infused food and drink products on the federal level.
Despite the prohibition of CBD-infused foods and beverages, several companies have been taking advantage of the trend in recent years.
David Klein, who founded The Jelly Belly Company in 1976, recently launched a line of CBD-infused jelly beans.
However, Jelly Belly later released a statement clarifying that it is not involved in the production of Klein's CBD-infused jelly beans, and that sale of the products "would currently be illegal for Jelly Belly" according to the FDA.
Several social users expressed their excitement over the prospect of a CBD-infused ice cream.
"I just read that Ben and Jerry's is working on a CB ice cream. Hell yes!" one person tweeted.
"Ben and Jerry's is superior," another person remarked in response to the news.
"Oh yes this is why I loooovvveeee this brand," someone else commented on Instagram.
