Two law enforcement officials confirmed to ABC7 that the federal agency is reviewing the decision to dismiss the charges, the Chicago-based station reported on Wednesday – one day after prosecutors announced their decision to drop the accusations against the Empire actor.
The Independent has contacted the FBI for comment.
Chicago prosecutors announced on Tuesday that all 16 felony counts against Smollett had been dismissed, in a surprise reversal of the case in which the actor had been accused of allegedly lying to the police about being the victim of a racist, homophobic attack in Chicago this January.
Smollett has maintained his innocence and he, along with his legal team and supporters, has presented the authorities’ decision as a personal vindication.
Others, such as Chicago Mayor Rahm Emanuel and Police Superintendent Eddie Johnson, have criticised the dismissal.
Smollett’s attorney issued a blistering statement on Wednesday accusing Chicago officials and police of trying to “smear” Smollett even after the case is closed.
“We are disappointed the local authorities have continued their campaign against Jussie Smollett after the charges against him have been dropped,” said attorney Patricia Brown Holmes. ”We should all allow Mr Smollett to move on with his life as a free citizen.”
Smollett had paid a $10,000 bond earlier in the case to get out of jail, and has now forfeited the sum.
The Cook County State’s Attorney’s Office told The Independent in a statement after it was revealed that the charges had been dropped: “After reviewing all of the facts and circumstances of the case, including Mr Smollet’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case.
“We stand by the Chicago Police Department’s investigation and our decision to approve charges in this case.”
